From The Regulators

The Securities and Exchange Commission recently announced the resignation of Randall Lee, regional director of the Los Angeles office. Lee, who has been with the SEC since 2001 and was responsible for enforcement and examination programs in several states, says he plans to explore private sector opportunities. His successor has not yet been named.

Chief Accounting Officers, Controllers

Denver-based Gasco Energy has promoted Peggy Herald to vice president, accounting and administration. Herald, who has more than 19 years of accounting experience for the oil and gas industry, has served as chief accounting officer since 2006 and continues in that position as well. In addition, the company named Keith Doss as controller. Doss has served in accounting and controller positions for Western Gas Resources, Ensign Oil and Gas, and Burlington Resources, among others.

Cambridge, Mass.-based foodservice business Libbey Inc. has appointed Scott Sellick chief accounting officer; Gregory Geswein replaces Sellick as chief financial officer. Geswein joins Libbey from Reynolds & Reynolds, where he was chief financial officer.

Forster

Pepsi Bottling Group, headquartered in Somers, N.Y., has tapped Thomas Lardieri to serve as vice president and controller. Lardieri has served as vice president, risk management, and general auditor of PepsiCo since June 2001. He replaces Andrea Forster, who was recently named vice president of finance for PBG’s North America business.

In Seattle, International Gold Resources announced the appointment of Rodolfo Michels as controller, overseeing the company’s financial management, budget, accounts receivable and accounts payable, and human resources functions. Prior to IGR, he served for 12 years at Newmont Mining Corp.

General Counsels, Corporate Secretaries

Merrillville, Ind.-based DirectBuy reports that Joe Yast has been named general counsel at the furniture showroom and home design center. Yast has a 30-year history with DirectBuy, as he launched his career by delivering furniture for the original United Consumers Club showroom. When Yast opened his own litigation firm in 1992, DirectBuy became a client. As general counsel, he will oversee franchise agreement compliance and be responsible for all litigation matters in addition to providing legal advice to various departments.

Jeffrey Leventhal was named general counsel and corporate secretary at Denver-based United Western Bancorp, replacing Theodore Abariotes, who is departing to spend more time with family. Leventhal comes to United Western from First Data Corp., where he served in various legal positions.

Herink

Administaff, a Houston-based provider of human resources services for small- and medium-sized businesses, has re-assigned John Spurgin from general counsel to special counsel to the corporation, while Daniel Herink will succeed Spurgin as general counsel and corporate secretary. Herink previously oversaw the company’s litigation and property and casualty insurance practice. Prior to Administraff, he was an attorney at Rodriguez, Colvin & Chaney.

Lear Corp., located in Southfield, Mich., announced two separate appointments: Wendy Foss has added the position of corporate secretary to her duties as vice president of finance and administration; and Liam Hart has been promoted to deputy general counsel. Both report to General Counsel Daniel Ninivaggi at the supplier of automotive seating, electronics, and electrical distribution systems.

Compliance Officers

New York-based Integro Insurance Brokers named Ian Ullman as chief compliance officer and risk manager. Ullman will work with senior officers to strengthen business efficiency and client service and ensure the company is compliant with applicable laws and regulations, in addition to overseeing the company’s insurance needs. Ullman was formerly litigation counsel at insurer Marsh & McLennan.

On The Board

Hyatt

Palo Alto, Calif.-based Hewlett-Packard has elected Current Media Chief Executive Officer Joel Hyatt to serve on its board of directors’ newly formed finance and investment committee and the HR and compensation committee. In addition, the board appointed John Joyce, a managing director for private equity firm Silver Lake, to its board and as a member of both the audit and technology committees.

uBid.com Holdings, a Chicago-based online marketplace, appointed Casey Gunnell as chairman of the audit committee and a member of its board of directors. Gunnell is CEO of Gunnell Family Corp., which provides interim management to several companies, including HealthSouth Corp., Calpine Corp., and Charter Communications.

Turner

Lynn Turner, a former chief accountant for the SEC, has left his job as managing director of proxy advisory firm Glass Lewis & Co. Turner did not disclose his reasons for departing, but Glass Lewis also lost Jonathan Weil as head of its research department, and Weil reportedly resigned in protest over new management at Glass Lewis. Turner, meanwhile, has also been named chairman of the audit committee at Guidance Software in Pasedena, Calif.

Pearl Meyer & Partners, a New York-based compensation consultancy, appointed David Swinford as president and chief executive officer, succeeding Joseph Rich, who has been named chairman and as a member of the executive committee. Swinford most recently served as head of the New York office. Joining Rich on the executive committee are Senior Managing Director James Hughes and Managing Director Matthew Stinner.

KPMG has announced that Teresa Pesce has joined its forensic practice and will head up its anti-money laundering service line in New York. Pesce will also be responsible for criminal and regulatory probes, including financial fraud cases and those surrounding the Foreign Corrupt Practices Act. Before joining KPMG, Pesce was executive vice president for global financial services firm HSBC, where she also took charge of the North American anti-money laundering unit.

Doyle

Marjorie Doyle, former chief ethics and compliance officer at DuPont and at Vetco, has joined ethics and compliance solutions provider LRN as a senior executive in the Los Angeles office. Doyle, will oversee a team of ethics and compliance professionals and will oversee overall company ethics initiatives.

BorderWare Technologies, based in Toronto, has released BorderWare Web Security Gateway and BorderWare IM Security Gateway. The BorderWare Security Platform consolidates e-mail, IM, and Web security in a single platform, which means companies can now use one device, rather than several, to protect all three applications. Borderware has also reduced up to 50 percent of ownership costs through the single solution.
