DEI programs are under attack. Compliance should help plan what comes next

U.S. President Donald Trump has proven himself to be a chaos agent in the opening weeks of his second term, firing federal workers, shuttering agencies, and issuing executive orders that attempt to upend policies and laws he doesn’t like.

By mischaracterizing policies meant to curb racism and discrimination and promote respect and opportunity for all different types of people into so-called “reverse racism” against white men, Trump has turned diversity, equity and inclusion (DEI) programs into a boogeyman. His order is being challenged in court, while 16 states issued guidance to help organizations better understand what DEI is about.

Trump launched his crusade against DEI with a Jan. 21 executive order that attempts to unwind DEI initiatives within both the government and the private sector, including universities and schools. According to the order, any federal contractor, or any organization that accepts federal grant monies, will have to certify in future contracts “that it does not operate any programs promoting DEI that violate any applicable federal anti-discrimination laws.”
